Massage Establishment and Therapist License

The City of Shawnee welcomes Massage Therapist to practice in our City. Massage businesses are only allowed in locations zoned Commercial Highway. Massage establishments are permitted in other zoning districts when they are an accessory business to a beauty salon, doctor's office or other similar type business. Massage Establishment applications are urged to contact the Planning Department at (913) 742-6011, to make sure the intended location is appropriately zoned.

A massage establishment license may not be required if you meet one of the exceptions of the Shawnee Municipal Code. Home based massage therapy is currently prohibited in the City of Shawnee, however, off-premise massage therapy is allowed at a patron's home.

The City will not issue licenses for Massage Establishments and Massage Therapists for the following reasons:

  • The applicant gives false answers on the application.
  • The applicant has been convicted of any crime that includes a felony, a crime involving sexual misconduct with children or any sex offense that falls under K.S.A. 21-3436 et seq.
  • The applicant has not successfully completed the required course of study or does not have the appropriate First Aid/CPR certification.

Massage Licensing Requirements

Massage Establishments

A license is required to operate a Massage Establishment within the City of Shawnee. Massage therapy may be performed in the following manners:

  • On the licensed premise of a massage establishment.
  • On the business premises of a massage patron.
  • Off-premise at a patron's home.

Regulations
Once the application has been submitted, it will be sent to the Police Department for a background investigation, the Planning Department to ensure zoning compliance, and the City Attorney to ensure compliance with the Shawnee Municipal Code. Final approval of a massage establishment is granted by the Community Development Department. The Licensing Specialist will also renew each license on an annual basis. The Licensing Specialist can deny a license for the following reasons:

  • The proposed site is not zoned appropriately.
  • The applicant gives false answers on the application.
  • If an individual; or any of the stockholders holding more than ten percent of the stock of the corporation, any of the officers and directors; or any of the partners, including limited partners; and the manager or other person principally in charge of the operation of the business, have been convicted of any crime that includes a felony, a crime involving sexual misconduct with children or any sex offense that falls under K.S.A. 21-3436 et seq.
  • The applicant has had a massage or massage establishment license denied, revoked or suspended in another city or state within five (5) years of the application.
  • The manager of the business would be ineligible to receive a license.
  • Inspections/Sign-Off.

Prior to opening, a massage establishment must have the following:

  • A building inspection and health inspection. These are both conducted by the City Codes Administration Division call (913) 742-6010.
  • A fire inspection. Contact the Fire Department at (913) 631-1080.
  • Planning Department approval: a signature from a City Planner (913) 742-6011, on a Sign-Off Sheet indicating that the location is zoned appropriately and that they have explained the City sign requirements to you.

Once the massage establishment has opened, the following regulations apply:

  • Massage establishments shall be closed and operations shall cease between 12:00 a.m. midnight and 6:00 a.m. each day.
  • Customers of the opposite gender must not receive treatment in the same room at the same time.
  • No alcoholic beverages shall be permitted on the premises of any licensed massage establishment.
  • No service which is clearly dangerous or harmful to the health or safety of any person shall be permitted.
  • Separate dressing rooms for each gender, with individual lockers, must be available on the premises.
  • All employees must be modestly attired; clothing must cover an employee's chest at all times; hemlines may be no higher than the top of the knee.
  • Private parts of patrons must be covered by towels, clothing or undergarments when in the presence of an employee.
  • Sheets and towels shall be laundered after each use.
  • Wet and dry rooms, showers and toilets shall be cleaned each day.
  • Each licensed establishment is required to keep a list of employees' names, addresses and license numbers on file.
  • Each licensed establishment is also required to keep a list of customers, hours of arrival and room assignment for the year. These lists shall be available for inspection by any Police Officer or the Codes Administration Division.

Application

  • Proof of age via a birth certificate or valid driver's license or other government-issued identification.
  • Fingerprints provided by the Shawnee Police Department. A valid receipt issued by the Community Development Department showing payment of the massage establishment fee must be presented to the Police Department.

Off-Premises Massage Therapy

A license is required to perform off-premises massage therapy. The licenses will be approved annually by the Community Development Department. Off-Premises Massage means any Massage Therapy performed at a patron's private residence in the City and specifically does not include the guest rooms of hotels or the private residence of the Massage Therapist. Off-Premises Massage Business means any business, not located in the City, where any person, firm, partnership, association, or corporation engages in or carries on massage therapy for compensation.

Regulations

  • Massage therapy performed at a patron's residence is limited to the hours between 6:00 a.m. and 10:00 p.m.
  • No service shall be given which is clearly dangerous or harmful in the opinion of the Director of the County Department of Health to the safety and health of any person.
  • All massage therapists shall be clean and wear clean outer garments.
  • All massage therapists must be modestly attired.
  • All private parts of patrons must be covered by towels, cloths, or undergarments when in the presence of the massage therapist. Any contact with the patron's genital area is prohibited.
  • A licensed massage therapist shall be present at all times when a student massage therapist is performing off-premises massage.

Student Massage Therapist

The City has adopted provisions to license students seeking to obtain professional experience in massage therapy. A license is required for a Student Massage Therapist to practice massage therapy. Applicants must be associated with a licensed Massage Establishment and work under the direction of a licensed Massage Therapist.

Regulations

  • All massage therapy must be conducted under the supervision of a Massage Therapist licensed in the City of Shawnee. Supervision means the supervising therapist is available on the premises and is personally aware the student is performing massage therapy on a client.
  • A supervising therapist must personally observe the student's massage techniques at least once during the massage therapy session.
  • All advertisements for massage therapy that will be performed by a student will clearly inform the customer that a student under the supervision of a licensed massage therapist will perform the massage therapy.
  • Prior to conducting any massage therapy, the Student Massage Therapist will require the customer to sign and acknowledge he/she has been informed the massage therapy will be conducted by a student under the supervision of a licensed Massage Therapist. These acknowledgment documents will be maintained by the supervising massage therapist for a period of one year and will be produced at the request of any law enforcement officer or City official.

  • Proof of age via a birth certificate or valid driver's license or other government-issued identification.
  • A copy of certificate certifying 300 hours of instruction in massage therapy from a recognized school.
  • Proof of successful completion of Red Cross First Aid and/or American Heart Association CPR Training.
  • Fingerprints provided by the Shawnee Police Department. A valid receipt issued by the Community Development Department showing payment of a massage therapist license must be presented to the Police Department.

Massage Therapist

All Massage Therapists must obtain a license and must be associated with a licensed Massage Establishment prior to performing Massage Therapy within the City.

Regulations

  • Must obtain a valid Massage Therapist license from the .
  • All massage therapy must be conducted on the premises of a licensed massage establishment or off-premise at a patron's business or off premises at a patron's home.
  • Private parts of patrons must be covered at all times.
  • Daily registers of patrons must be kept on file and must be open to inspection by any employee of the Codes Administration Division or Police Department and shall include hours of arrival, rooms or cubicles assigned, types of services performed, and name and address of patron's home or business for off-premise massage.

  • Proof of age via a birth certificate or valid driver's license or other government-issued identification.
  • A copy of a diploma or graduation certificate certifying 500 hours of instruction in massage therapy from a recognized school and proof of successful completion of the National Examination of Therapeutic Massage and Bodywork OR the Massage and Bodywork Licensing Examination (MBLEx).
  • Certification of CPR training and first aid.
  • Fingerprints provided by the Shawnee Police Department. A valid receipt issued by the Community Development Department showing payment of a massage therapist license must be presented to the Police Department.
