Analysis of Impediments to Fair Housing Choice
The city of Shawnee is strongly committed to affirmatively furthering fair housing. The CDBG program provides a platform to affirmatively further fair housing, and partner with other Johnson County programs and local organizations that promote self-sufficiency, to help residents strive toward meeting their basic needs, and reduce barriers to fair housing. The program funds various public service projects and provides support through the combined efforts of sub-grantees and other partners participating in these efforts. This reduces discrimination and leads to self-sufficiency for Shawnee’s residents most in need of assistance.
The U.S. Department of Housing and Urban Development (HUD) requires that all communities receiving federal housing and CDBG funding complete an Analysis of Impediments (AI) to Fair Housing Choice. The AI outlines the impediments to fair housing choice in the public and private sectors.
About Fair Housing
In 2010, the City of Shawnee entered into a consortium agreement, along with eight other municipalities in the Kansas City Metropolitan area, with BBC Research and Consulting to perform an AI. The AI was completed in late 2011, with several key findings. The most notable finding regarded the need to provide better access to information and resources related to fair housing, including how to file a fair housing complaint at the state and federal level. The results of the AI have been incorporated into the City’s 2012 Consolidated Action Plan. Also as a result of the findings of the AI, the City of Shawnee amended portions of the zoning ordinance to allow for by-right inclusion of group homes.
Types of Housing Discrimination
Whether people are trying to rent, buy, sell, or finance a home or apartment, as a tenant, homeowner, or landlord, rights and protections are provided by the Federal Fair Housing Act. Illegal housing discrimination can take many forms. Examples include:
- Realtors showing apartments or homes only in certain neighborhood
- Advertising housing only to preferred groups of people
- Denials of property insurance
- Discriminatory property appraisals
- Refusals to make reasonable accommodations for persons with disabilities
Reports across the country indicate that those who are low-income, seniors or disabled, seeking to purchase, refinance, or secure a reverse mortgage, are often targets for predatory lenders or loan fraud. Predatory lenders take advantage of borrowers with a variety of abusive practices, such as charging excessive interest rates or loan fees.

The Fair Housing Act
The Fair Housing Act of 1968 prohibits discrimination in housing because of:
- Race or Color
- National Origin
- Family Status
The Fair Housing Act prohibits discriminatory practices based upon race or color, national origin, religion, sex, familial status or disability in the sale of housing, rental of housing, and mortgage lending.
The Fair Housing Act covers most housing. In some circumstances the Act exempts owner-occupied buildings with no more than four units, single-family housing sold or rented without the use of a broker, and housing operated by organizations and private clubs that limit occupancy to members.
