1. BZA-04-17-04; VARIANCE REQUEST FROM SMC SECTION 17.60.030 (B) TO ALLOW A SIX (6’) FOOT PRIVACY FENCE TO BE PLACED WITHIN THE PLATTED SIDE-YARD SETBACK AREA. THE PROPERTY THAT IS THE SUBJECT OF THIS VARIANCE REQUEST IS LOCATED AT 5813 HASKINS STREET. BRET MCCLURE, PROPERTY OWNER, SUBMITS THE APPLICATION.

E. ADJOURNMENT

Attached Staff Report:

The applicant requests a variance of Section 17.60.030 (B) to allow a six (6’) foot privacy fence to be placed within the platted side-yard setback area. The property that is the subject of this variance request is located at 5813 Haskins Street. Bret McClure, property owner, submits the application.

In review of the variance request, staff notes the following:

2. Properties to the north, east and west are zoned R-1 as well. Properties to the north and west have been developed with single family residential homes, while property to the east is common open space that is owned by the Pflumm Woods homes association. Right-of-way for Johnson Drive is located directly south of the property.
3. The corner lot is rectangular in shape and contains approximately 23,568 square feet of property. The owner desires to build a 6-foot tall privacy fence adjacent to Johnson Drive to buffer this arterial street. The proposed fence would extend southward from the house to enclose the majority of the side yard. The (east) rear yard of the lot is adjacent to open space that will remain undeveloped.
4. The Zoning Regulations allow placement of a four and one-half (4 ’) foot privacy fence “by right” within the required side yard. The applicant has expressed the six foot fence is needed to buffer their rear from the adjacent busy arterial street, as well as screen the back yard from the numerous people who walk on the Johnson Drive sidewalk that is next to their property.
